INFORMATION CLAUSE

Pursuant to Art. 13.1 and 13.2 of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC 2016/679 (hereinafter referred to as the GDPR), let us inform you that:

  1. To ensure a relevant protection of your personal data, the Data Controller has appointed a Data Protection Officer (hereinafter referred to as the DPO), i.e. Mrs Justyna Rytel-Kuc. If the DPO is absent, the function is taken by a deputy DPO, i.e. Mr Tadeusz Zawistowski. Personal data protection issues can be consulted with the DPO:

    1. by mail at the Data Controller’s address specified in Section 1;

  1. Your personal data are processed for the following purposes:

    1. for recruitment, including, without limitation:

      • based on Art. 6.1.c) of the GDPR in conjunction with Art. 22 1 § 1 of the Labour Code, Art. 2 and 3 of the Act of 15 June 2012 on consequences of ordering work to foreigners illegally staying within the territory of the Republic of Poland;

      • based on your consent (Art. 6.1.a) of the GDPR) if you have disclosed personal data exceeding the scope of data set out by law;

      • based on your consent (Art. 6.1.a) of the GDPR or Art. 9.1.a) of the GDPR) for future recruitment purposes;

    1. to support the regularisation of stay and work of temporary workers

      • based on Art 6.1.c) of the GDPR in conjunction with Par. 7.1.4 of the Regulation of the Minister of Family, Labour and Social Policy of 7 December 2017 on issuing work permits to foreigners and entering statements on employing foreigners in the record of statements

    1. to perform the agreement

      • based on Art. 6.1.b) of the GDPR

    1. to guarantee the safety of property and people staying within the Data Controller’s premises by use of a CCTV system

      • based on Art. 6.1.f) of the GDPR

    1. for marketing purposes

      • based on your consent (Art. 6.1.a) of the GDPR)

  1. Your personal data can be disclosed to authorised entities if this is required by law (e.g. at a request of public authorities or if the rights are claimed before courts). Your personal data will be processed to the extent necessary to achieve the goals by entities providing services to the Data Controller, including in particular: IT, hosting, electronic communications, bank, financial and accounting services, services of subcontractors and companies of the Fast Service Capital Group.

  1. Your personal data will be stored:

    1. in the case of personal data processed for recruitment purposes:

      • for the recruitment period and for 3 months after the end of recruitment;

      • for 3 years or until the withdrawal of your consent if you have agreed that your personal data will be used for future recruitment purposes;

    2. to support the regularisation of stay and work of temporary workers

      • for 10 or 50 years in accordance with the Labour Code;

    3. to perform the agreements:

      • till the termination or expiry of the agreement, however no longer than stipulated in applicable legal regulations, e.g. in connection with claims, settlements, complaints etc.

    4. in the case of the use of CCTV:

      • for 7 days or until the lawful end of proceedings where CCTV records are used as evidence.

  1. You provide your personal data voluntarily, however the data are necessary to achieve the above goals.

  1. If the personal data are processed on the basis of your consent, the consent is voluntary and can be withdrawn at any time. The withdrawal of the consent is without prejudice to the compliance of processing based on the consent given before such withdrawal. You can withdraw your consent by contacting our DPO (Section 2 hereof).

  1. In connection with the processing of your personal data by the Data Controller, you have the following rights:

      • Right of access to your data

      • Right of rectification of your personal data

      • Right to erase your personal data

      • Right to data portability

      • Right to withdraw your consent to the processing

      • Right to lodge a complaint with the supervisory authority, i.e. the Personal Data Protection Office if you believe that the processing of your personal data violates the personal data protection regulations.

  1. Your personal data can be transferred to third states.

  1. Your personal data are not subject to automated decision making, including profiling.
